Squirrels are diurnal, meaning they’re active during daylight hours rather than at night. If you’re hearing scratching or scurrying sounds in your attic or walls during the morning or around dusk, that timing points toward squirrels rather than nocturnal pests like mice or rats.

Chewed wood, siding, or wiring around the roofline, soffits, or eaves
Nesting material made of leaves, twigs, and grasses found in the attic
Droppings concentrated near entry points or nesting areas
Visible gaps in soffits, fascia boards, vents, or around chimney flashing

New York State Rules for Squirrel Removal

Eastern gray squirrels are classified as a protected species in New York, regulated by the NYSDEC under the Environmental Conservation Law. A property owner can remove a gray squirrel causing damage on their own property without a license, but the animal can’t be transported off that property without a Nuisance Wildlife Control Operator (NWCO) permit. That license, issued by the NYSDEC, is required for anyone who charges a fee to trap, possess, transport, or release nuisance wildlife.
